CFTC Order Blocking Kalshi Election Bets Overturned by Judge

A federal judge cleared a path for Kalshi Inc. to let Americans use derivatives on its exchange to bet on November’s election — throwing a wrench in a top US regulator’s crackdown.

The order from Judge Jia Cobb on Friday paves the way for Kalshi to start offering products that let people bet on which party will win control of Congress.

The Commodity Futures Trading Commission, which oversees the exchange, had ordered Kalshi not to offer the derivatives.

Kalshi hailed the move as a watershed moment that would let Americans trade on the election in a US-regulated market. “Election markets are now legal in the United States for the first time in 100 years,” said Tarek Mansour, co-founder and chief executive officer of Kalshi.

The CFTC, which can appeal the decision, didn’t immediately respond to a request for comment.

Although some countries allow betting on elections, the US has taken a tougher stance. The CFTC has generally blocked derivatives from being used to wager on political contests and in May proposed an explicit ban.

The CFTC gives exchanges significant leeway to decide what derivatives to list. But the agency can stop contracts relating to “terrorism, assassination, war” and “gaming,” which the CFTC is still in the process of defining, as well as those deemed to be “contrary to the public interest.”

The CFTC said it blocked Kalshi’s contracts on who would control Congress because election gambling is unlawful in certain states, the trading would harm election integrity and the agency isn’t in a position to police elections.

At the time, Kalshi called the move “an unlawful agency power grab that corrupts and dramatically expands” the agency’s statutory mandate. The firm sued.

Kalshi offers a type of derivative known as an event contract. Ordinary people and Wall Street traders can use those products to bet legally on various outcomes, including monetary policy, lunar landings and music awards.
